Waiver and Release

In consideration of Feathered Knechtions LLC providing You this service, You specifically release and forever discharge Feathered Knechtions LLC from any and all liability or claims for injury, illness, death or loss of or damage to property which You may suffer while using these Goods and participating in its activity. This discharge specifically includes, but is not limited to, liability or claims for injury, illness, death or damage caused by the negligence of Feathered Knechtions LLC or its officers, agents, or employees. It is Your intent by the Waiver and Release Agreement to release the Company and hold it harmless from all liability for any such property loss or damage, personal injury or loss of life, whether caused by negligence or whether based upon breach of contract, breach of warranty, or any other legal theory. You express agreement with this policy by Your payment in and participation in this provided service.

Acknowledgement

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and Feathered Knechtions LLC. These Terms and Conditions set out the rights and obligations of all users regarding the use of the Hatch at Home Utah Service. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms and Conditions which is finalized with Your purchase of the Hatch at Home Rental Kit. These Terms and Conditions apply to all visitors, users and others who access or use this service.

By placing an Order for Goods through the Service, You warrant that You are legally capable of entering into binding contracts. You agree to be bound by these Terms and Conditions. If You disagree with any part of these Terms and Conditions do not place an order as You may not access the Service.

You represent that you are over the age of 18. The Company does not permit those under 18 to use the Service. Your access to and use of the Service is also conditioned on Your acceptance of and compliance with the Privacy Policy of the Company. Our Privacy Policy describes Our policies and procedures on the collection, use and disclosure of Your personal information when You use the Application or the Website. 

 If You wish to place an Order for Goods available on the Service, You may be asked to supply certain information relevant to Your Order including, without limitation, Your name, Your email, Your phone number, Your credit card number, the expiration date of Your credit card, Your billing address, and Your shipping information.

You represent and warrant that:

(i) You have the legal right to use any credit or debit card(s) or other payment method(s) in connection with any Order; and that (ii) the information You supply to us is true, correct and complete. By submitting such information, You grant us the right to provide the information to payment processing third parties for purposes of facilitating the completion of Your Order.

Order Cancellation

We reserve the right to refuse or cancel Your Order at any time for any reason. We reserve the right to refuse or cancel Your Order if fraud or an unauthorized or illegal transaction is suspected. Pricing Policy

Feathered Knechtions LLC reserves the right to revise its prices at any time prior to accepting an Order. The prices quoted may be revised by Feathered Knechtions LLC subsequent to accepting an Order and if that occurs, You will have the right to cancel Your Order.

Payments

All Goods purchased are subject to a one-time payment. Payment can be made through various payment methods as they become available through our website or in-person such as credit cards or other online payment methods (PayPal, or Venmo for example).

Dispute Resolution

In the event of any concerns or disputes You agree to first try and resolve the dispute informally with Feathered Knechtions LLC.

Our Order Policies: Cancellation, Rescheduling, and Return Last updated: October 12, 2022

Thank you for your purchase with Feathered Knechtions LLC.  If, for any reason, You are not completely satisfied with a purchase We invite You to review our Order policy on rescheduling, refunds, and returns.  The following terms are applicable for Feathered Knechtions LLC’s Hatch at Home Utah program that You purchased from us.

Your Order Rescheduling and Cancellation Rights

You are entitled to reschedule Your Order Start Date, without any cancellation fees, up until 7 days prior to your scheduled Start Date without giving any reason for doing so. The deadline for cancelling an Order is prior to any payment received by Us confirming your Order. Once Your Order is confirmed, any cancellation of Your Order will be subject to a $75 cancelation fee. No refunds will be issued once Order Start Date has begun. In order to exercise Your right of reschedule or cancellation, You must inform Us 7 days prior to Your scheduled start date.

Hatching: We cannot guarantee that every egg will hatch as many variables come into play for a chick to successfully hatch. It is also typical for a chick or two to die within the first few days after hatching.  We will not refund nor replace eggs that didn’t hatch or chicks that die.  We will not reimburse nor otherwise authorize any veterinary costs incurred by You during the hatching process or keeping of chicks. Hatching Kit Rental: 

Your Feathered Knechtions LLC Hatching Kit Rental includes all equipment necessary to hatch and keep chicks for up to 7 days from the date the first chick is hatched.  You are responsible for, at your own expense, any additional equipment including feed that you may require during the hatching and 7 day keeping process.  Chick Rental and Chick Rental Kit:  Your Chick Rental Kit includes all equipment necessary to keep chicks for up to 7 days from the Start Date.  You are responsible for, at your own expense, any additional equipment including feed that you may require during the 7 day rental.  We do not guarantee that every chick will live through the 7 day rental.  We will not refund nor replace chicks that die.  We will not reimburse nor otherwise authorize any veterinary costs incurred by You during the rental period. You agree to contact us immediately should any chick die.  

Your Order Return Requirements

You are required to return the entire chick rental kit by the provided Return Date as specified in Your Order.  Late returns will be subject to a late fee of $100 per week (not prorated).  You agree You will return the Goods in Your rental kit, in the same good condition as when received, ordinary wear and tear accepted, and to repair and replace lost or stolen, damaged or broken Goods or to reimburse Us for said Goods.  You are responsible for returning the Goods to the same location you picked them up (unless alternative location is agreed on between parties prior to pickup). Keeping Chicks

If you plan to keep your chicks from the rental kit you are responsible for purchasing all the necessary equipment needed to properly care for the chicks and any incurring costs including veterinary care. You are solely responsible for complying with all local / county / community regulations regarding keeping quail on Your property.
